12 January 2012
AstapovLawyers International Law Group has protected the interests of a majority shareholder of a major Ukrainian business group in legal proceedings about the granting of an injunction in the form of the right to administer a group of companies.
The proceedings were caused by a lawsuit filed by a minority shareholder with the a Manx court in May 2010. At his request, the court removed the then management which represented the majority shareholder from directing the group of companies. As a result, the authority to administer the affairs of the company passed to the receivers appointed by the court.
The qualified actions of AstapovLawyers lawyers who represented the interests of the majority shareholder in partnership with Manx attorneys (the dispute was heard in the jurisdiction of the British isle) soon yielded a successful result. The first-tier court discharged the order made previously.
The minority shareholder attempted to appeal against the judgment in the court of appeal, the High Court of Justice of the Isle of Man. However, owing to the effective collection and organisation of evidence base by AstapovLawyers lawyers, the majority shareholder also prevailed in the court of appeal.
“This victory comes as the result of hard work of the company’s lawyers who did their best to create a quality evidence base. It was due to the well-founded case of our lawyers that our client was able to protect its rights to the operation administration of its business group. We congratulate all the lawyers who were involved in the case on the victory which was made possible thanks to the high professionalism and well-coordinated work of the entire team,” remarked Oleh Beketov, AstapovLawyers’ Counsel.
