A large-scale GAFTA Arbitration between Dutch B.V. and Austrian AG has been finalized by way of settlement between the Parties. The history of the dispute dates back to 2002 with legal proceedings at GAFTA Arbitration at the first tier and appeals.
In this Arbitration a number of important legal issues arose. These include the issue of loading windows at the Port of Novorossiysk and the relationship between contractually agreed shipment dates and so called "loading windows" customarily agreed in this particular port, the legal issues of anticipatory breach in English law etc.
